New York Divorce Trials: What You Need To Know

You might have already attempted to resolve things outside of court with your soon to be ex-spouse. If you are unable to do so or if you have recently received the paperwork that your spouse filed, and you are not sure how to proceed, now is the time to schedule a consultation with a Brooklyn family lawyer who is familiar with how the court works.

Any divorce trial is a gamble because there are many different factors that can cause uncertainty. Sometimes, however, you need to be familiar with what to expect if your divorce case does go to trial. You will only have to go to trial in your divorce case if you are unable to settle it in advance.

Settling Your Brooklyn Divorce

Settling your divorce case prior to trial is often the best choice because it allows you to have significant control over the outcome of your case. If you are not able to settle in mediation or negotiations, you will have to go to trial in front of a judge who may not understand your choices, values, experiences, and background.

Since it is a significant gamble and you don’t know who you’ll end up standing in front of, many people choose to pursue mediation because it also allows for a more flexible outcome that could be better for you and your former spouse to establish rules around.

Key Legal Issues In A New York Divorce

Outside of settlement, a divorce trial is the only way for courts to make final determinations about your case and the key legal issues that must be addressed such as child custody, child support, spousal support, and alimony. All of these issues must be addressed prior to the conclusion of your divorce case and you might attempt to resolve them on your own.

Any issues that you resolve on your own will minimize the amount of time spent going to court and the money you spent having your attorney protect you.

Your Brooklyn Divorce Attorney Can Guide You Through The Process

Your divorce lawyer may not be able to promise whether or not you’ll have to go to trial in your case but can give you a better perspective on what is involved in these types of cases and how to prepare for trial or avoid it.

Ms Brown, is an Extraordinary person, she’s calm, very professional, has a wonderful personality easy to work with and always has your best interests in mind. She handed my “nasty” divorce in such a calm and professional way that it shocked me and the opposing side. She doesn’t talk too much or annoys the judge but when she does it is right on point. I highly recommend this amazing person. I can be grateful enough to Ms Brown.

It was recommended to me that I get in touch with Mary Katherine through an acquaintance who works in the field. I can confidently say it was one of the best decisions I had made. I went through a complicated separation process and custody battle over my two year old son; my case was extremely challenging and before I retained the services of Mary Katherine it seemed as though all was lost. Mary Katherine and Eoin O' Mahony worked tirelessly on my case and managed to guarantee my access to my son and reach an agreement that protected my relationship with him and secured my status as his father. They did so with the utmost of professionalism, compassion, and generosity. I truly cannot recommend her warmly enough.
